The situation

With no academic contacts and an industry resume, the assumption was that cap-exempt roles meant a pay cut and a lab bench. The concurrent H-1B provision changed that calculation entirely.

The four categories that qualify

  • Institutions of higher education
  • Nonprofit entities related to or affiliated with such institutions
  • Nonprofit research organizations
  • Governmental research organizations

The search method

  • Listed every teaching hospital and research institute within 60 miles
  • Cross-checked each against public LCA filings to confirm they sponsor
  • Applied to core staff roles - data, engineering, program management - not only research roles
  • Asked in the first screening call who the petitioning entity would be

Adding the concurrent role

Once the cap-exempt petition was approved, a part-time role at a for-profit company was added through a concurrent H-1B. That employer had never won a lottery slot, and did not need to.

The portability limit worth knowing

Cap exemption belongs to the employer, not the person. Moving to a for-profit employer as the only job requires going through the cap, so the concurrent structure was deliberately kept in place.
